Negligent Handling of Guardianship Application Caused Irreparable Harm - based on my opinion & experience I retained Robert McGlashan (Sept 24') to represent me in a time-sensitive guardianship application involving my elderly parents. Unfortunately, what followed was a series of professional failures that caused escalating emotional, financial, and legal harm to both myself and my vulnerable family members — particularly my mother, who I had been denied access to for nearly four months. Robert failed to file critical court materials properly and on time, and when I felt forced to try and salvage the mishandling of my application, and in trying to secure a 4+ month trial date, the opposing parties received access to my evidence long before any hearing was held (none of which Robert sought or reviewed after repeatedly being asked "should I not be giving supporting evidence?). In my opinion, he broke privilege and disclosed a confidential legal strategy to the very individuals I was seeking protection from — resulting in the weaponization of a retaliatory Peace Bond application against me to negatively impact the protection I was seeking for my parents. That single event further empowered those already isolating, pressuring, and financially exploiting my parents, and it has had long-term consequences that continue today. The emotional, psychological, and financial impacts of his (I feel) negligence have been profound. Despite formally raising my grave concerns directly with Robert numerous times and with the firm’s partners, not a single person has shown professionalism to respond or acknowledge well-documented failures, while harm continues and I remain cut off from my own mother. This is deeply painful and should never have happen!. This could have — and should have — been prevented had Robert acted promptly with even basic competence, care and compassion to protect in a timely manner to reduce further isolation and abuse. In firing Robert (Feb 2025), over $16,500 in retainer funds were spent under the belief that I was pursuing an application to protect my mother. In reality, nearly five months (and counting) were lost, and all his efforts failed to secure our scheduled court date, so his retention proved to be fruitless. Nothing was accepted by the court due to procedural deficiencies, missed deadlines, failure to file materials correctly, and failure to secure opposing counsel’s consent to amend the application — a change Robert himself deemed necessary due to the Peace Bond proceedings that his own missteps initiated though his disclosed of intent to file the day after he was retained. It seems to be the opinion of a boutique specialized lawyer (sought for advice) and now my newly retaining counsel, that the materials Robert had filed were best not salvageable. We are being forced to abandon ALL his work entirely and begin the process again — at considerable cost, delay, and emotional duress/toll. The lack of accountability or even response from Reeves Richarz firm partners, who were notified of the serious missteps, concerns and impact only compounds the damage done thus far. My intended purpose to protect my mom has now had experienced detrimental setbacks and increased my exposure to risk/liability on multiple levels Thankful I was able to retain new council (now criminal and new civil) but at a significant, unnecessary and unexpected additional cost. To others, the mistake of hiring the wrong lawyer could have meant the ALL the difference in providing any protecting to a loved one or none at all. So based on my experience, I cannot recommend Robert McGlashan — especially for matters involving vulnerable individuals, elder protection, or urgent legal intervention. Overall, I am disappointed in RRicharz lack of followup and accountability to the mishandling of a clients file and with the exception of Paige, who did a fantastic job drafting a Statement of Claim for another situation, the consequences of inaction, mismanagement, and poor judgment in this case have been both lasting and deeply personal.
