Interestingly, we have taken on cases that other experienced Counsel have refused. In the early 1990s when my client ran out of unemployment benefits, while the father and ex-spouse refused to pay any child or spousal support, we took her case without a retainer because justice demanded it. We fought for arrears of child support in excess of $100,000.00, and an increase in child support since the payor/father lived a life of luxury and opulence. After a full hearing in the Superior Court of Justice in Guelph, my client and her daughter finally received the justice they truly deserved. Notwithstanding the Court Order in her favour, we continued our involvement to ensure that the payor in fact complied with his legal obligations. When he failed to make his child support payments, we brought a Motion for Contempt and had him jailed on two separate occasions. We lobbied the Department of Justice to embrace other measures such as license suspensions, passport suspensions, garnishment of tax refunds and benefits from non-compliant parents which eventually became law in Ontario and Canada.
